A bill to fundamentally change the patent system is gathering steam in Congress. In its current form, passage of the bill would significantly impact technology innovation.
Highlights of the bill include:
- Right of first inventor to file
- Revised definition of "prior art"
- Instituting a post-grant review system
- Assignee filing - will allow non-inventors to apply for a patent
- Publication of all patent applications after 18 months
- Limitations on awards in lawsuits for patent infringement
- Limitations on the ability of patent holders to stop infringers
