July 27, Pending Patent Reform Legislation: How Will It Affect Technology Innovators?

 

A bill to fundamentally change the patent system is gathering steam in Congress.  In its current form, passage of the bill would significantly impact technology innovation.

 

Highlights of the bill include:

  • Right of first inventor to file
  • Revised definition of "prior art"
  • Instituting a post-grant review system
  • Assignee filing - will allow non-inventors to apply for a patent
  • Publication of all patent applications after 18 months
  • Limitations on awards in lawsuits for patent infringement
  • Limitations on the ability of patent holders to stop infringers
