COURT UPHOLDS $134.5 MILLION DAMAGES VERDICT IN PATENT CASE

Irvine, California - Knobbe, Martens, Olson & Bear, LLP, is pleased to announce that, after post-trial motions, on July 14, 2004, Judge Mariana Pfaelzer upheld an earlier jury verdict of $134.5 million in favor of its client, Masimo Corporation. The court upheld the jury verdict that two of Masimo's patents were infringed. The court also sustained the jury verdict by rejecting Nellcor's post-trial challenges alleging invalidity of Masimo's patents. Finally, the court sustained the jury verdict rejecting Nellcor's claim that Masimo's sensors and connector cables infringe one of Nellcor's patents.
