Professional Profile

Alan Kessler is an associate in our San Diego office. Mr. Kessler’s practice focuses on litigation of intellectual property; particularly, with respect to patents and trademarks.  He has policed and enforced client trademarks, resulting in numerous favorable settlements.  He has also represented clients in trademark litigant, recovering substantial monetary judgments from infringers.

Mr. Kessler has represented both plaintiffs and defendants in patent lawsuits involving technology ranging from electronic control systems to pharmaceuticals.

Mr. Kessler joined the firm in 2007.

Representative Matters

The Rockefeller University v. Ligand Pharmaceuticals, Inc. (S.D.N.Y. 2008-2009).  Assay Technology related to Drug Development.  Representing defendant in a technology license dispute relating to GlaxoSmithKline's Promacta-brand product. Obtained favorable settlement prior to expert discovery.

99¢ Only Stores v. 99¢ Plus Discount Store, et. al., C 07-6395 CRB (N.D. Cal.)  After obtaining judgment against defendants for trademark infringement, initiated contempt proceedings on behalf of client 99¢ Only Stores, which resulted in a favorable settlement including payment of monetary damages.

Roche Palo Alto LLC v. Ranbaxy Labs. Ltd., (D.N.J. 2006-  ).  Pharmaceuticals.  Representing defendant in patent litigation regarding valganciclovir (active ingredient in Roche’s Valcyte® anti-viral product).
