Computer Docking Station Corp. v. Dell, Inc., Gateway, Inc., and Toshiba America, Inc., et al., U.S. District Court, Western District of Wisconsin, Case No. 06-C-0032-C. The firm successfully defended Toshiba in a patent infringement lawsuit brought in Madison, Wisconsin by Computer Docking Station Corporation ("CDSC"). CDSC had sued several laptop computer companies with the expectation CDSC could obtain settlements for alleged infringement of a patent that covers brick computers. Although some defendants settled, Toshiba had two other accused infringers elected to show the court that the asserted patent was very narrow and did not cover laptop computers. After obtaining a favorable claim construction in August, and conducting extensive briefing on two sets of opposing summary judgement motions, the firm and its co-counsel convinced the court that the case should be dismissed. The court granted summary judgment of non-infringement and dismissed the case on January 12, 2007. |
