Graduate Student Business Plan Competition

LES Spring Meeting - Montreal, Canada

The LES Foundation in cooperation with The Licensing Executives Society (U.S.A. and Canada), Inc., and The Licensing Executives Society International (LESI) invite MS/MBA/JD/PhD students from around the world to participate in the 2009 LES Foundation Graduate School Business Plan Competition.

To participate, entrants must submit a comprehensive business plan with a core intellectual property (IP) licensing component. Entries will be judged on a variety of factors including attractiveness of the venture, quality of the product/service offered, market opportunity, and investment potential. Five finalist teams will receive all-expense paid trips to compete in Montreal and attend the 2009 LES Spring Meeting, where teams will present their plans and have the opportunity to network with licensing professionals representing all aspects of the industry. The winning team will be announced during the meeting and will receive $10,000 and valuable in-kind prizes. Each runner-up team will win $1,000. Finalist teams will also compete for LESI's $5,000 Global Award.

Patents on computer software and business methods have been playing an increasingly important role for many businesses. The Court of Appeals for the Federal Circuit recently issued a long-awaited decision redefining the test for patent eligibility for these types of inventions. Under the Bilski test, to be patent eligible a claimed process must: 1) be tied to a particular machine or apparatus, or 2) transform a particular article into a different state or thing. While this test appears to set forth more specific requirements than the prior State Street decision’s “useful, concrete, and tangible result” test, it certainly does not provide any bright line as to patent eligibility for processes that involve no physical interaction or machine.
